1. Parties

The Yogo service (hereafter "the Service") is provided by Samflyt AS, a Norwegian limited company, business registration number 920 470 645, registered address Kjosdalen 42, 4623 Kristiansand, Norway, e-mail post@yogo.day, hereafter "the Provider".

The user ("the Customer") is the natural person who registers an account and uses the Service. These terms constitute the agreement between the Provider and the Customer.

2. The Service

Yogo is a personal productivity service offering journal, tasks, lists, calendar, email integration, file sharing and AI-assisted reflection ("Yumi"). The Service is delivered as cloud software (SaaS) and requires internet access and a modern web browser.

The Service is under active development. Features may change, be added, or be removed. Material changes affecting paid features will be announced in advance — see section 14.

3. Account and use

• You must be at least 16 years old to create an account. Users under 16 require parental consent.
• The information you provide at registration must be accurate and kept up to date.
• You are responsible for protecting your password. We recommend unique, strong passwords.
• One account per person. Accounts are personal and may not be transferred.
• You must notify us immediately if you suspect unauthorized access to your account.

4. Pricing and payment

Current pricing:

• Trial: Free for 7 days. No payment method required.
• Daily: 99 kr per month. Includes full access and 500,000 AI tokens per month.
• Daily Plus: 299 kr per month. Includes full access and 2,500,000 AI tokens per month.

All prices are in Norwegian kroner (NOK). The Provider is registered for Norwegian VAT, and VAT is included in the stated prices.

Payment is processed via Vipps. The amount is charged in advance for the upcoming monthly period. The subscription renews automatically every month until you cancel. If payment fails, we will notify you and retry after a few days. If payment still fails after 14 days, AI features may be locked until payment is resolved.

AI usage beyond included allowance

Important: AI usage ("Yumi" / Claude / Whisper) beyond the monthly token allowance included in your subscription is billed separately. Included allowances are:

• Trial: 100,000 tokens for the entire trial period
• Daily: 500,000 tokens per month
• Daily Plus: 2,500,000 tokens per month

Once the allowance is exhausted, AI features are blocked by default. You may choose to enable auto top-up in blocks of 50 kr (granting approximately 100,000 additional tokens per block). Top-up requires explicit activation in /settings/billing, and you may at any time set a monthly cap (the default cap is 200 kr/month) or disable auto top-up entirely. You will be notified before each top-up.

Token usage per AI call is shown on /settings/billing. One A4 page of text is typically 500–1000 input tokens; a detailed Yumi response uses 500–2000 output tokens.

5. Trial period

New users receive a 7-day free trial with full access to AI features within a budget of 100,000 tokens. No payment information is required to start the trial.

After 7 days, AI features are locked until you upgrade. Your data and entries are retained for at least 90 days after trial expiry so you have time to decide.

6. Right of withdrawal

Under the Norwegian Right of Withdrawal Act (Angrerettloven, Act of 20 June 2014 no. 27), consumers have a right to withdraw from the agreement within 14 days of conclusion.

For digital services the following applies: If you have consented to immediate delivery of the Service, and expressly acknowledged that the right of withdrawal lapses once delivery is completed, the right of withdrawal is limited for content already consumed. This typically applies to AI-generated responses and stored content already in use.

However, you always have the right to cancel the subscription at any time without specific cause — see section 7.

To exercise the right of withdrawal within the 14-day window, send an email to post@yogo.day stating that you are cancelling, or use the standardized withdrawal form available at forbrukertilsynet.no. Refunds are processed to the same payment method within 14 days of receiving the notice.

7. Termination

• You may cancel the subscription at any time from /settings/billing.
• Cancellation takes effect at the end of the current billing period. There is no lock-in.
• You retain full access until cancellation is effective.
• After cancellation, you can export all your data for 90 days (Markdown, PDF, ZIP). After 90 days, the account and all associated data are permanently deleted.
• The Provider may terminate the agreement with 30 days' notice for material breach, illegal use, or service discontinuation. You will be given the opportunity to export your data before deletion.

8. Privacy

We process personal data in accordance with the Norwegian Personal Data Act and the EU General Data Protection Regulation (GDPR). A separate privacy policy is available at yogo.day/trust#privacy.

Summary:

• We store personal data (name, email, locale, subscription status, content you create, AI usage statistics) to deliver the Service.
• Data is stored with our infrastructure provider within the EU/EEA.
• We do not sell personal data to third parties and do not use it for external marketing.
• You always have the right to access, rectification, erasure, data portability, and restriction of processing. Contact post@yogo.day.
• You may file a complaint about personal data processing with the Norwegian Data Protection Authority (Datatilsynet).

9. AI processing and sub-processors

To provide AI features ("Yumi") we use the following data processors:

• Anthropic PBC (USA) — Claude models for text analysis, summaries, suggestions, and chat responses. Anthropic has confirmed that they do not use API data to train their models.
• OpenAI L.L.C. (USA) — Whisper for voice note transcription. OpenAI does not use API data for model training.

Transfers to the USA are made under the EU–US Data Privacy Framework and Standard Contractual Clauses (SCC). You can opt out of AI features by disabling them in /settings/yumi, but this will significantly limit the usefulness of certain parts of the Service.

Logs of AI calls (without content, only metadata: kind, model, tokens, status) are stored for 30 days for debugging and cost control, then deleted.

10. User responsibilities

You agree not to:

• Use the Service for illegal purposes or in violation of Norwegian law
• Attempt to circumvent AI budget limits or other technical controls
• Distribute harmful code (malware, viruses) via the Service
• Infringe third-party copyright or other intellectual property rights through content you store or share
• Misuse sharing or messaging functions for spam, harassment, phishing, or other unwanted communication
• Attempt to access other users' data without express permission

The Provider reserves the right to suspend accounts for clear breaches. Where practical, you will be given notice and an opportunity to remedy the breach before suspension.

11. Intellectual property

• You retain full ownership of all content you create in the Service (journal entries, tasks, emails, voice notes, attachments).
• You grant the Provider a limited, non-exclusive license to store, display, process and transmit your content solely for the purpose of delivering the Service to you. The license terminates when you delete the content or your account.
• The Yogo software, user interface, design, documentation, and trademark "Yogo" belong to the Provider and are protected by copyright and trademark law.
• AI-generated responses are produced by third-party models. You can use them freely, but be aware that output may resemble other independently produced text.

12. Availability and disclaimers

• We do our best to keep the Service up, but provide no guarantee of 100% uptime.
• Scheduled maintenance windows are announced at least 24 hours in advance where practical.
• External services (Anthropic, OpenAI, Vipps, IMAP providers, internet providers) may have their own downtime affecting Yogo functionality. Such matters are outside our control.
• AI responses may contain errors. Models can hallucinate facts or misinterpret context. Always evaluate critical information before acting on it.
• We back up data daily, but recommend that you export important content regularly yourself (available via /settings).

13. Limitation of liability

To the extent permitted by law, the Provider's total liability to the Customer is limited to the amount the Customer has paid for the Service in the 12 months preceding the event.

The Provider is not liable for indirect losses, lost profits, lost work time, or consequential damages, beyond what follows from mandatory consumer protection law.

The Norwegian Consumer Purchase Act and Right of Withdrawal Act apply to consumers regardless of these terms where applicable.

14. Changes to the terms

The Provider may amend these terms. Material changes are announced at least 30 days before they take effect, both by email to your registered address and as an in-app notice.

If you do not accept the changes, you can cancel your subscription without charge before they take effect. Continued use after the changes have taken effect constitutes acceptance.

Minor editorial changes (typos, clarifications, link updates) may be made without notice.

15. Complaints and dispute resolution

If you believe the Provider has not fulfilled the agreement:

1. Contact us first at post@yogo.day. We normally respond within 5 working days and do our best to resolve the matter amicably.
2. If we cannot reach agreement, you may complain to a relevant public body:
   • Forbrukertilsynet (Norwegian Consumer Authority) — for marketing practices and unfair terms.
   • Forbrukerrådet (Consumer Council) — for guidance and mediation.
   • Forbrukerklageutvalget (Consumer Complaints Tribunal) — for binding decisions in consumer cases.
   • Datatilsynet — for complaints about personal data processing.
3. As a consumer resident in the EU/EEA, you may also use the European Commission's online dispute resolution platform: ec.europa.eu/consumers/odr.

16. Governing law and venue

This agreement is governed by Norwegian law. Disputes shall first be sought resolved amicably. Failing that, Kristiansand District Court (Kristiansand tingrett) is the agreed venue, unless otherwise required by mandatory consumer protection law.
